Texas Vehicle Transfer of Ownership Form

A gift tax of $10 applies to a person who receives the vehicle from a spouse, parent or step-parent, grandparent or grandchild, child or stepchild, sibling, guardian, estate of the deceased or a 501(c)(3) non-profit organization. If you submit a vehicle transfer notice and continue to receive parking tickets and/or tolls, you may contact the department to receive a confirmation letter or submit a Texas Motor Vehicle Information Request (Form VTR-275) indicating the month and year in which the vehicle was transferred. If you are buying from a natural person, a motor vehicle sales tax (6.25%) must be paid on the purchase price or standard presumption value (whichever is higher) when the vehicle is titled. If the transaction takes place on a Saturday or Sunday and the seller decides to remove his license plates and registration stickers from the vehicle, you will need to download the vehicle`s transit authorization. This way, you can legally drive the vehicle to the district tax office or, if the district tax office is closed, to a location of your choice. This authorization is valid for five calendar days and only one authorization can be issued per vehicle sale. If your spouse had a will, the vehicle is part of the estate process. Form VTR-346, Texas Motor Vehicle Transfer Notification, is a legal document that you must complete to inform the authorities that you have sold or transferred ownership of a vehicle. Legal advice is required because it demonstrates the mutual consent of the parties to enter into a transaction, describes the transferred vehicle, and protects a seller and buyer in the event of disputes or disagreements after the sale. If you submit this document, you also disclaim any liability for civil or criminal acts affecting the vehicle. Vehicles must be issued in the name of the buyer within 30 days of the date of sale. If a vehicle is not properly transferred on behalf of the buyer, this can result in the seller being liable for tickets, toll violations or even crimes involving the vehicle. To make sure this doesn`t happen to you, accompany the buyer to your county tax office to make sure an application for a vehicle title is submitted. A dealer is not required to use the dealer`s name when you sell or trade your vehicle to a licensed motor vehicle dealership. The vehicle remains in your name until it is sold to someone, which can take months or, in some cases, years.

To protect yourself, submit a vehicle transfer notification. When a vehicle delivery notification is received, TxDMV updates the vehicle registration to show the vehicle as it is sold. The seller is required to submit Form VTR-346 within 30 days of the date of delivery of the vehicle. You can do this electronically on the Texas DMV website or by mail – submit the form to the TxDMV Vehicle Titles and Registration Division, PO Box 26417, Austin, TX 78755-0417. You must provide proof of liability insurance when you own and register your vehicle. If you do not provide proof of insurance, you can request “title only”. A seller must keep detailed written records of each transaction, including buyer`s contact information, date of sale, and vehicle information, including Vehicle Identification Number (VIN). If a vehicle is issued on the basis of a divorce decree, give your district tax office a certified copy of the decree and apply for the title. If the decree does not award the vehicle, a properly assigned title (when your ex-spouse transferred the title to you) is required. .
